Terms of Service

These Terms of Service ("Terms") govern your use of HostVista ("the Service"), operated by MantaVision Labs ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use HostVista.

Service Description

HostVista helps vacation rental hosts create digital guest guides. You can build guides that include check-in instructions, WiFi details, house rules, local recommendations, and more — then share them with your guests via a simple link. The Service also provides analytics features.

Account Terms

• You must be at least 16 years old to use the Service.
• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the security of your account and password.
• One person or legal entity may maintain no more than one free account.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

Acceptable Use

You agree not to use HostVista to:

• Violate any applicable laws, regulations, or third-party rights.
• Upload, publish, or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Attempt to gain unauthorized access to the Service, other accounts, or any connected systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service for spam, phishing, or distributing malware.
• Scrape, crawl, or use automated means to access the Service beyond what is reasonably needed for intended use.

We reserve the right to suspend or terminate accounts that violate these terms.

Content Ownership

You retain full ownership of any content you create, upload, or share through the Service, including guide text, images, and property details ("Your Content").

By using the Service, you grant MantaVision Labs a non-exclusive, worldwide, royalty-free license to host, display, and distribute Your Content solely for the purpose of operating and providing the Service. This license ends when you delete Your Content or your account.

Intellectual Property

The HostVista name, logo, brand, website design, and all underlying code and technology are the intellectual property of MantaVision Labs. These Terms do not grant you any right to use our branding, trademarks, or proprietary materials except as needed to use the Service as intended.

Payment Terms

• Some features of the Service require a paid subscription.
• Subscriptions are billed in advance on a recurring basis (monthly or annually).
• All payments are processed securely through Stripe. We do not store your credit card details.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

Service Availability

We strive to keep HostVista available and reliable, but we cannot guarantee uninterrupted access. The Service is provided on a "best effort" basis. We may occasionally need to perform maintenance, updates, or experience downtime due to circumstances beyond our control. We will make reasonable efforts to notify users of planned maintenance in advance.

Limitation of Liability

To the maximum extent permitted by law, MantaVision Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claim related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or $100, whichever is greater.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Termination

You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms or for any other reason with reasonable notice.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you by email or through a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of HostVista after the updated Terms become effective constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.
